Bu engellerin 5 g\u00fcnden fazla kald\u0131r\u0131lmamas\u0131 durumunda, masraf\u0131 %20 fazlas\u0131yla kamu taraf\u0131ndan tahsil edilerek engeller kald\u0131r\u0131l\u0131r. Tekrar eden ihlallerde ceza \u00fcst s\u0131n\u0131rdan verilir.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00d6rnek<\/strong>: Bir plajda yap\u0131la\u015fmay\u0131 engelleyen bir duvar in\u015fa ederseniz, 2,000 TL ile 10,000 TL aras\u0131nda bir para cezas\u0131 \u00f6demek zorunda kal\u0131rs\u0131n\u0131z. Uygulama imar plan\u0131 bulunan yerlerde ise belirli yap\u0131lar yap\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">Bilirki\u015fi raporuna g\u00f6re, su\u00e7a konu ruhsats\u0131z bina maliye hazinesine ait ve sahil \u015feridinin ilk 50 metresi i\u00e7inde yer almaktad\u0131r. <em>Bu nedenle san\u0131\u011f\u0131n eylemi, k\u0131y\u0131 kanununa ayk\u0131r\u0131d\u0131r:<\/em><\/p>\n<p style=\"text-align: justify;\">&#8220;\u2026 <em>San\u0131\u011fa y\u00fckletilen imar kirlili\u011fine neden olma eylemiyle ula\u015f\u0131lan \u00e7\u00f6z\u00fcm\u00fc hakl\u0131 k\u0131l\u0131c\u0131 zorunlu \u00f6\u011felerinin ve bu eylemin san\u0131k taraf\u0131ndan i\u015flendi\u011finin Kanuna uygun olarak y\u00fcr\u00fct\u00fclen duru\u015fma sonucu saptand\u0131\u011f\u0131, b\u00fct\u00fcn kan\u0131tlarla a\u015famalarda ileri s\u00fcr\u00fclen iddia ve savunmalar\u0131n temyiz denetimini sa\u011flayacak bi\u00e7imde ve eksiksiz sergilendi\u011fi, \u00f6zleri de\u011fi\u015ftirilmeksizin tart\u0131\u015f\u0131ld\u0131\u011f\u0131, vicdani kan\u0131n\u0131n kesin, tutarl\u0131 ve \u00e7eli\u015fmeyen verilere dayand\u0131r\u0131ld\u0131\u011f\u0131, Eylemin do\u011fru olarak nitelendirildi\u011fi ve Kanunda \u00f6ng\u00f6r\u00fclen su\u00e7 tipine uydu\u011fu belirlenmi\u015ftir. Y\u00fcr\u00fcrl\u00fckteki 3621 say\u0131l\u0131 K\u0131y\u0131 Kanununun 4.maddesi \u201ck\u0131y\u0131\u201dy\u0131, \u201ck\u0131y\u0131 \u00e7izgisi ile k\u0131y\u0131 kenar \u00e7izgisi aras\u0131ndaki alan\u201d olarak tan\u0131mlam\u0131\u015ft\u0131r. K\u0131y\u0131 \u00e7izgisi \u201cDeniz, tabii ve suni g\u00f6l ve akarsularda, ta\u015fk\u0131n durumlar\u0131 d\u0131\u015f\u0131nda, suyun karaya de\u011fdi\u011fi noktalar\u0131n birle\u015fmesinden olu\u015fan \u00e7izgiyi,\u201d k\u0131y\u0131 kenar \u00e7izgisi ise \u201cDeniz, tabii ve suni g\u00f6l ve akarsularda, k\u0131y\u0131 \u00e7izgisinden sonraki kara y\u00f6n\u00fcnde su hareketlerinin olu\u015fturuldu\u011fu kumluk, \u00e7ak\u0131ll\u0131k, kayal\u0131k, ta\u015fl\u0131k, sazl\u0131k, batakl\u0131k ve benzeri alanlar\u0131n do\u011fal s\u0131n\u0131r\u0131n\u0131\u201d ifade etmektedir. \u201cSahil \u015feridi\u201d yine ayn\u0131 maddede \u201ck\u0131y\u0131 kenar \u00e7izgisinden itibaren kara y\u00f6n\u00fcnde yatay olarak en az 100 metre geni\u015fli\u011findeki alan\u201d olarak tarif edilmi\u015ftir. Sahil \u015feritlerinde yap\u0131lacak yap\u0131lar Kanuna g\u00f6re k\u0131y\u0131 kenar \u00e7izgisine en fazla 50 metre yakla\u015fabilir, Yakla\u015fma mesafesi ve k\u0131y\u0131 kenar \u00e7izgisi aras\u0131nda kalan alanlar, ancak yaya yolu, gezinti, dinlenme, seyir ve rekreaktif ama\u00e7la kullan\u0131lmak \u00fczere d\u00fczenlenebilir (m.5). Uygulama imar plan\u0131 bulunmayan alanlardaki sahil \u015feritlerinde, 4 \u00fcnc\u00fc maddede belirtilen mesafeler i\u00e7inde hi\u00e7 bir yap\u0131 ve tesis yap\u0131lamaz. Uygulama imar plan\u0131 bulunan yerlerde duvar, \u00e7it, parmakl\u0131k, tel\u00f6rg\u00fc, hendek, kaz\u0131k ve benzeri engeller olu\u015fturulamaz. Moloz, toprak, curuf, \u00e7\u00f6p gibi kirletici ve \u00e7evreyi bozucu etkisi olan at\u0131k ve art\u0131klar d\u00f6k\u00fclemez, kaz\u0131 yap\u0131lamaz. Ancak bu alanlarda; uygulama imar plan\u0131 karar\u0131yla alt\u0131 ve yedinci maddede belirtilen yap\u0131 ve tesislerle birlikte toplum yarar\u0131na a\u00e7\u0131k olmak \u015fart\u0131yla konaklama hari\u00e7 g\u00fcn\u00fc birlik turizm yap\u0131 ve tesisleri yap\u0131labilir (m.8). Kanunun 15\/5. maddesinde ise \u201ck\u0131y\u0131da ve uygulama imar plan\u0131 bulunan sahil \u015feritlerinde\u201d ruhsats\u0131z veya ruhsat ve eklerine ayk\u0131r\u0131 olarak yap\u0131 yapan ki\u015filere T\u00fcrk Ceza Kanunu veya \u0130mar Kanunu h\u00fck\u00fcmlerine g\u00f6re verilecek ceza bir kat art\u0131r\u0131laca\u011f\u0131 h\u00fckm\u00fc d\u00fczenlenmi\u015ftir. Dosya i\u00e7erisindeki mevcut bilirki\u015fi heyetinin raporuna g\u00f6re, su\u00e7a konu ruhsats\u0131z binan\u0131n \u00fczerinde bulundu\u011fu alan maliye hazinesine ait olup, k\u0131y\u0131 kenar \u00e7izgisinden itibaren sahil \u015feridinin ilk 50 metresi i\u00e7erisinde kalmaktad\u0131r. \u00d6yleyse sahil \u015feridinde ruhsats\u0131z bina in\u015fa etti\u011fi belirlenen san\u0131\u011f\u0131n eyleminde 3621 say\u0131l\u0131 K\u0131y\u0131 Kanunun15\/5.maddesi uyar\u0131nca verilen cezan\u0131n bir kat art\u0131r\u0131l\u0131p art\u0131r\u0131lmayaca\u011f\u0131 hususunun tart\u0131\u015f\u0131lmas\u0131 bak\u0131m\u0131ndan su\u00e7a konu yerde uygulama imar plan\u0131n\u0131n olup olmad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi g\u00f6zetilmemi\u015f ise de aleyhe temyiz olmad\u0131\u011f\u0131ndan bozma yap\u0131lamayaca\u011f\u0131, Anla\u015f\u0131ld\u0131\u011f\u0131ndan, san\u0131k &#8230;\u2019nin ileri s\u00fcrd\u00fc\u011f\u00fc nedenler yerinde g\u00f6r\u00fclmemi\u015f olmakla, tebli\u011fnamedeki isteme uygun olarak, TEMY\u0130Z DAVASININ ESASTAN REDD\u0130YLE H\u00dcKM\u00dcN ONANMASINA,\u2026karar verildi.\u2019<\/em><\/p>\n<p><strong>Hukuk Dairesi 2021\/9682 E. , 2022\/33 K. <\/strong><\/p>\n<p style=\"text-align: justify;\">\u00d6zet:<\/p>\n<p style=\"text-align: justify;\"><strong>I. K\u0131y\u0131larla sahil \u015feritlerinin, kullan\u0131l\u0131\u015f ama\u00e7lar\u0131na g\u00f6re derinli\u011fi ve ki\u015filerin bu yerlerden yararlanma imkan ve \u015fartlar\u0131 kanunla d\u00fczenlenir.&#8221; d\u00fczenlemesi ve bu d\u00fczenleme gere\u011fince \u00e7\u0131kar\u0131lan 3621 Say\u0131l\u0131 K\u0131y\u0131 Kanunu&#8217;nun &#8220;Genel Esaslar&#8221; ba\u015fl\u0131kl\u0131 5. maddesinde &#8220;K\u0131y\u0131lar ile ilgili olarak k\u0131y\u0131lar\u0131n Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda oldu\u011fu, herkesin e\u015fit ve serbest olarak yararlanmas\u0131na a\u00e7\u0131k oldu\u011fu, yararlanmada \u00f6ncelikle kamu yarar\u0131 g\u00f6zetildi\u011fi, k\u0131y\u0131da ve sahil \u015feridinde planlama ve uygulama yap\u0131labilmesi i\u00e7in k\u0131y\u0131 kenar \u00e7izgisinin tespitinin zorunlu oldu\u011fu, sahil \u015feritlerinde yap\u0131lacak yap\u0131lar\u0131n k\u0131y\u0131 kenar \u00e7izgisine en fazla 50 metre yakla\u015fabilece\u011fi, yakla\u015fma mesafesi ve k\u0131y\u0131 kenar \u00e7izgisi aras\u0131nda kalan alanlar, ancak yaya yolu, gezinti, dinlenme, seyir ve rekreaktif ama\u00e7la kullan\u0131lmak \u00fczere d\u00fczenlenebilece\u011fi, k\u0131y\u0131larda hi\u00e7bir yap\u0131 yap\u0131lamayaca\u011f\u0131, duvar, \u00e7it, parmakl\u0131k, tel \u00f6rg\u00fc, hendek, kaz\u0131k ve benzeri engeller olu\u015fturulamayaca\u011f\u0131 \u015feklinde genel esaslar d\u00fczenlenmi\u015ftir. 6.3.
